The Ministry of Finance has officially notified a new tax amnesty scheme aimed at non-resident Indian (NRI) students, working professionals, and individuals who have recently relocated to India. The scheme provides a legal mechanism for taxpayers to voluntarily declare previously undisclosed overseas financial assets, bank accounts, and foreign investments without facing harsh criminal prosecution or severe financial penalties under existing anti-black money legislation.
The framework operates under the broad principles of the Undisclosed Foreign Income and Assets (Imposition of Tax) Act, 2015, commonly known as the Black Money Act. Historically, foreign income earned by individuals while living abroad often remained unrecorded upon their return to resident status due to complex compliance procedures, leading to unintended tax defaults when automatic exchange of information mechanisms like FATCA and CRS detected these accounts.
Under the notified rules, eligible individuals can declare their foreign holdings by paying a designated tax rate alongside a moderated penalty fee within a specified compliance window. The Central Board of Direct Taxes (CBDT) clarified that immunities will apply strictly to foreign assets acquired through legitimate income sources, excluding cases linked to money laundering, corruption, or illegal activities under the Prevention of Money Laundering Act (PMLA).
This notification is highly relevant for GS Paper III (Economy, Black Money, and Direct Tax Reforms).
