The Securities and Exchange Board of India (SEBI) has officially signed a Memorandum of Understanding (MoU) with the European Securities and Markets Authority (ESMA) regarding mutual cooperation and information exchange concerning Central Counterparties (CCPs). The agreement establishes a formal framework for regulatory collaboration, cross-border supervision, and systemic risk mitigation between Indian and European capital market authorities.
The MoU comes in the backdrop of regulatory friction over third-country CCP recognition framework enforced by European regulators. Central Counterparties play a pivotal role in clearing and settling financial transactions, guaranteeing settlement even if a market participant defaults. Enhanced bilateral sharing helps protect cross-border capital flows and financial stability between India and the European Union.

Key regulatory entities involved include clearing corporations licensed under SEBI's Securities Contracts (Regulation) Act, 1956. ESMA acts as the chief financial market regulator and supervisor for the European Union's capital markets infrastructure.
