Signs bilateral agreement with European regulator ESMA to enhance regulatory oversight of Central Counterparties.
The Securities and Exchange Board of India (SEBI) entered into a Memorandum of Understanding (MoU) with the European Securities and Markets Authority (ESMA) to enhance bilateral cooperation and information exchange regarding Central Counterparties (CCPs). The agreement establishes a formal mechanism for cross-border regulatory oversight, risk assessment, and supervisory cooperation between Indian and European capital market authorities.
Central Counterparties are critical financial market infrastructures (FMIs) that interpose themselves between counterparties to trading contracts, acting as buyer to every seller and seller to every buyer. This MoU comes in the backdrop of past regulatory friction when European authorities sought direct audit access over Indian clearing corporations (such as CCIL), which SEBI resisted on grounds of financial sovereignty and regulatory jurisdiction over domestic clearing institutions.
Under the MoU framework, SEBI and ESMA will share critical supervisory information, crisis management protocols, and regulatory updates pertaining to clearing entities. India’s major CCPs include the Clearing Corporation of India Limited (CCIL), NSE Clearing Limited, and BSE’s Indian Clearing Corporation Limited. These institutions ensure trade settlement, margin enforcement, and mitigation of systemic credit risks across equity, debt, and foreign exchange derivative markets.
This development fits prominently under Economy and Financial Regulators. Prelims questions may test the definition and role of CCPs, statutory powers of SEBI under the SEBI Act 1992, or roles of clearing corporations in capital markets.
