Signed a cross-border regulatory agreement with ESMA to enhance supervision and exchange information on Central Counterparties.
The Securities and Exchange Board of India (SEBI) signed a Memorandum of Understanding (MoU) with the European Securities and Markets Authority (ESMA). The bilateral agreement establishes a framework for regulatory cooperation, information sharing, and mutual supervision regarding Central Counterparties (CCPs) operating between India and the European Union.
Central Counterparties play a crucial systemic role in financial markets by clearing and settling trades, effectively guaranteeing transaction settlement between buyers and sellers. Cross-border recognition of CCPs became a friction point in late 2022 when ESMA de-recognized several Indian CCPs, including the Clearing Corporation of India, due to audit access disagreements with Indian regulators.
The newly signed agreement aligns SEBI and ESMA regulatory oversight mechanisms under international standards established by the Committee on Payments and Market Infrastructures and the International Organization of Securities Commissions (CPMI-IOSCO). It facilitates seamless clearing operations for EU banks operating within Indian capital and derivative markets without compromising domestic sovereignty.
This pact strengthens bilateral trade infrastructure and capital flows between India and Europe.
