Supreme Court Directs Strict Enforcement of Mandatory Speed Governor Norms

The Supreme Court of India has issued strict directives to state governments and transport authorities to ensure rigorous enforcement of speed-limiting devices (SLDs) or speed governors across all commercial and public transport vehicles. Expressing deep concern over lax compliance despite mandates dating back over a decade, the bench stressed that non-enforcement directly compromises public safety and human life on Indian highways.

Under the Motor Vehicles Act, 1988, and central motor vehicle rules, speed governors were mandated for commercial vehicles to curb over-speeding, which accounts for the vast majority of fatal road accidents in India. The Supreme Court highlighted that despite clear legislative frameworks and prior judicial instructions, enforcement mechanisms at the state transport department level have remained severely compromised, leading to widespread tampering and non-compliance.

India accounts for nearly 11% of global road accident fatalities despite possessing only 1% of the world’s vehicle population, recording over 1.5 lakh deaths annually. The Supreme Court directed all state enforcement agencies to submit compliance reports, conduct periodic physical inspections of transport fleets, and penalize manufacturers or operators found bypassing calibrated speed limits.
