Direct Srinagar Deputy Commissioner to appear after finding a detention order issued without application of mind.
The Jammu and Kashmir High Court has summoned the Deputy Commissioner of Srinagar in connection with a preventive detention order issued under the Public Safety Act (PSA). The court noted that the administrative order was passed without proper application of mind.
Justice Nargal observed that the nature of the allegations, the apparent absence of specific material particulars on the grounds of detention, and concerns regarding how the order was formulated warrant further judicial examination.
