In Brief
The Supreme Court observed that marital discord between spouses cannot be an automatic ground to seek termination of an advanced, over-six-month pregnancy under the Medical Termination of Pregnancy (MTP) Act, in the absence of any medical danger to the mother or substantial fetal abnormalities.
The Supreme Court addressed an abortion plea of a woman seeking approval to terminate her pregnancy exceeding 24 weeks due to discord with her husband, who opposed the termination asserting his rights regarding the unborn child. The Bench emphasized that under the MTP Act, marital discord alone does not satisfy the statutory exceptions permitted beyond the 24-week limit for a viable fetus.
