The Ministry of Home Affairs has issued a comprehensive directive to all state governments and Union Territory administrations, demanding the timely submission of foreign extradition applications and the immediate upgrade of prison facilities to meet international humanitarian standards. The Home Ministry specifically requested updated status reports regarding ongoing extradition cases and infrastructure compliance in state correctional facilities. The advisory comes in the backdrop of several high-profile extradition requests facing judicial scrutiny in foreign courts, where foreign judges frequently reject India's extradition pleas citing overcrowded, unsanitary, and inhumane conditions in Indian prisons. Standardizing prison infrastructure aligns with international human rights covenants and strengthens India's legal standing when requesting foreign governments to hand over fugitives accused of economic offenses or terrorism. Key directives emphasize adhering to strict timelines when preparing official extradition dossiers under the Extradition Act of 1962. States must also adopt the Model Prison Act of 2023, ensuring modern security, proper medical facilities, video conferencing setups, and adequate personal space for prisoners to conform with international norms prescribed by the United Nations Standard Minimum Rules for the Treatment of Prisoners. This news is critical for UPSC General Studies Paper Two and Paper Three, touching upon prison reforms, legal frameworks, public order, and international criminal justice cooperation. Aspirants can expect questions on fundamental rights of prisoners under Article 21, provisions of the Extradition Act, statutory mandates of the National Human Rights Commission, and structural law enforcement reforms.
