SEBI permits Foreign Portfolio Investors to use digitally signed Power of Attorney documents to streamline investment onboarding.
The Securities and Exchange Board of India (SEBI) has issued a regulatory framework permitting Foreign Portfolio Investors (FPIs) to submit digitally signed Power of Attorney (PoA) documents during their onboarding process. This step modernizes operational compliance, reducing documentation delays for foreign institutional investors entering Indian financial markets.
Previously, foreign investors were required to submit physical copies of legal documents, including wet-signed and notarized PoAs, which often led to extended processing timelines. The move aligns with the capital market regulator's objective to enhance operational efficiency, promote digital governance, and simplify foreign capital inflows under existing Ease of Doing Business initiatives.
Key aspects of the directive include the validation of digital signatures under recognized international and domestic legal frameworks. Designated Depository Participants (DDPs) are tasked with verifying electronic credentials while ensuring strict adherence to Anti-Money Laundering (AML) and Know Your Customer (KYC) norms applicable to cross-border investment flows.
For competitive exams, this decision is significant for understanding capital market regulations and measures to attract foreign direct and portfolio investments. Questions in Prelims can focus on SEBI guidelines for FPIs, while Mains questions may address reforms aimed at improving India's Ease of Doing Business landscape.
