High Court denies superannuation benefits to employee who secured public job using fraudulent SC certificate.
The Madras High Court ruled that a public servant who secured employment under a reserved category using a fraudulent community certificate is not entitled to terminal or superannuation benefits. Justice D. Bharatha Chakravarthy held that fraudulent procurement of a reservation certificate vitiates the very appointment from the beginning.
Affirmative action under Article 15(4) and Article 16(4) of the Indian Constitution provides reservation in public employment for Scheduled Castes, Scheduled Tribes, and Other Backward Classes. However, misrepresentation and submission of fake caste credentials undermine the constitutional mandate of social justice by depriving genuine beneficiaries of rightful opportunities.
The High Court placed reliance on the landmark Supreme Court ruling in Kumari Madhuri Patil v. Additional Commissioner (1994). The apex court mandated the establishment of State Scrutiny Committees to verify caste certificates, establishing that benefits obtained through fraud are void ab initio and warrant immediate recovery.
