The Indian Embassy in the United States issued a formal statement reaffirming that the Union Territories of Jammu & Kashmir and Ladakh are, have been, and will 'always remain an integral and inalienable part of India,' while clarifying that no territory termed 'Pakistani Kashmir' exists. The statement was made in response to international references and disputes over Kashmir's territorial status, asserting India's legal and constitutional position.
India's position on Kashmir is grounded in the Indian Constitution's Article 370 (now abrogated) and the Instrument of Accession signed by Maharaja Hari Singh on October 26, 1947, which made the princely state of Jammu and Kashmir accede to India. The Constitution originally provided special status to J&K but this was revoked on August 5, 2019, through Presidential order under Article 356. Simultaneously, J&K was bifurcated into two Union Territories: Jammu & Kashmir, and Ladakh. This reorganisation is India's constitutional position, though internationally contested by Pakistan.
Pakistan maintains that the Indus Waters Treaty (1960) and UN Security Council Resolutions 47 and 51 (from 1948) provide international sanction to its claim over parts of Kashmir. Pakistan administers approximately 85,000 sq km in the north (Gilgit-Baltistan), while China controls approximately 38,000 sq km (Aksai Chin). India administers approximately 222,000 sq km. India's official position rejects all external references to 'Pakistani Kashmir,' using instead the term 'Pakistan-Occupied Kashmir' (PoK).
