Directed official review of denied claims under Forest Rights Act 2006 in J&K to protect traditional forest dwellers.
The Jammu and Kashmir administration has directed officials to conduct an urgent review of all rejected land claims filed under the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006. The government warned administrative officials of FIRs under legal provisions if forest dwellers are illegally evicted without following due process and verifying claims through designated Gram Sabhas.
Following the abrogation of Article 370 in August 2019, central legislation including the Forest Rights Act (FRA) was extended to the Union Territory of Jammu and Kashmir. Historically, tribal populations like the Gujjars and Bakarwals lacked statutory rights over forest lands they inhabited for generations. Implementation had faced bottlenecks, leading to large-scale rejections of individual and community forest rights claims.
Under the FRA 2006, forest-dwelling Scheduled Tribes (FDST) and Other Traditional Forest Dwellers (OTFD) who have resided in forests for three generations (75 years prior to December 13, 2005) are eligible for tenure security. The Gram Sabha acts as the statutory primary authority to initiate the process of determining individual or community forest rights.
